Who is the personal data administrator?
Avco Coatings sp z o.o. with its registered office in Warsaw, ul. Halki 23, implements the personal data protection policy provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/WE (General Data Protection Regulation), hereinafter referred to as the "Regulation."

What is the basis, scope, and purpose of the processed data?
In accordance with the Regulation, we inform you that personal data is information about an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
Personal data collected by Avco Coatings Sp z o.o. includes:
- name, surname, shipping address, telephone number, email address, IP address,
- invoice data (NIP, REGON, PESEL),
- vehicle data: vehicle registration number, VIN chassis number.
Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
Data administrator means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the administrator or the specific criteria for its nomination may be provided for by Union or Member State law; thus, in the avco-partner.com store, the personal data administrators are Piotr and Krzysztof Warchoł, running a civil partnership under the name Avco Coatings sp. z o.o. with its registered office in Warsaw (postal code 04-885) at ul. Halki 23, identified by KRS number 0000565857, NIP 9522137949, REGON: 361955038, e-mail: contac@avco-partner.com, tel. (+48 607496951).
Processor means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the administrator.
Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.1
Personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, un2authorised disclosure of, or access to, personal data transmitted, stored or otherwise processed.
Personal data is collected for the purposes of:
- a. performance of the agreement concluded with Avco Coatings sp z o.o. and based on the consent expressed by the Client,
- b. marketing, i.e., informing about promotional campaigns, participation in contests, newsletter information, provided the Client has given separate consent for this purpose,
- c. consideration of complaints, pursuing and defending against mutual claims,
- d. maintaining the user account.
Personal data is provided voluntarily. Consent is expressed electronically and can be withdrawn at any time by sending a message to the address: contact@avco-partner.com. We inform you that the lack of consent to the processing of personal data to the extent necessary for the performance of the agreement may result in the order not being processed. The data subject has the right to withdraw consent for their processing. The withdrawal of consent may be expressed at any time, but it does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
Personal data for the purposes specified in section 4 letters a and c will be processed for 5 years from the end of the year in which the sales agreement was concluded, and for the purposes specified in section 4 letters b and d – until consent for their processing is withdrawn.
Personal data will be processed by persons authorized by the personal data administrator and by entities providing IT, postal, and advisory services (legal, accounting) for Avco Coatings sp z o.o. (based on specific agreements).
What rights do you have towards Avco Coatings sp z o.o. regarding data processing?
The data subject may request that Avco Coatings sp z o.o. informs them about, among other things:
- the purposes of the processing;
- the categories of personal data processed;
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
- the planned period for which the personal data will be stored, or, if that is not possible, the criteria used to determine that period.
Avco Coatings sp z o.o. informs the data subject via:
- a) registered letter;
- b) electronic means.
The data subject has the right, without giving a reason, to demand from the administrator the rectification or erasure of personal data, the restriction of processing of personal data, the data portability of personal data, access to personal data (including receiving a copy thereof), and to object to such processing. The requests referred to in the preceding sentence may be carried out by electronic mail to the address contact@avco-partner.com or by registered mail to the address ul. Halki 23, 04-885, Warszawa. If Avco Coatings Sp. z o.o. does not take action requested by the data subject, it shall immediately – no later than within one month of receiving the request – inform the Buyer of the reasons for not taking action and the possibility of lodging a complaint with the President of the Personal Data Protection Office and other legal remedies.
Actions taken by Avco Coatings sp z o.o. in fulfilling the obligations specified in points 9 and 10 are free of charge. However, if the requests are evidently unfounded or excessive, Avco Coatings sp z o.o. may: a) charge a reasonable fee, taking into account the administrative costs of providing the information, communication, or taking the requested action, or b) refuse to take action in connection with the request. Avco Coatings sp z o.o. informs every recipient to whom the data was disclosed about the rectification, supplementation, erasure, or restriction of the processing of personal data. This obligation is excluded if its fulfillment proves impossible or requires a disproportionately large effort. Avco Coatings sp z o.o. informs data subjects about the steps taken regarding informing entities processing personal data.
What safeguards do we use?
The Administrator, taking into account the state of technical knowledge, implementation costs, and the nature, scope, context, and purposes of processing, as well as the risk of violation of the rights or freedoms of natural persons of varying likelihood and severity of the threat, applies appropriate technical and organizational measures to ensure the protection of the processed Personal Data appropriate to the threats and categories of data subject to protection, and in particular secures the data against unauthorized access, removal by an unauthorized person, processing in violation of applicable regulations, and alteration, loss, damage, or destruction. External disclosure of information about the technical and organizational measures used to ensure processing protection may weaken their effectiveness and thus threaten the proper protection of Personal Data.
The Administrator appropriately provides technical means preventing the acquisition and modification of Personal Data transmitted electronically by unauthorized persons:
- The avco-partner.com website uses a secure "https" connection, the security of which consists in encrypting all information about the transaction being concluded.
- Data collection protection against unauthorized access through authorization and limited access range.
To whom do we disclose your data?
Your data may be transferred exclusively for the purposes indicated in this document. In connection with the services we provide, we use the services of third-party companies.
We transfer your data to:
- hosting companies that provide us with their servers,
- providers of tools used for marketing or analytical purposes, unless the user effectively objects to such processing of their data by disabling the use of cookies in the internet browser,
- providers of tools for sending emails,
- persons cooperating with us on the basis of civil law contracts,
- internet service providers, e.g., Google Analytics, Microsoft Clarity,
- providers of software for customer or potential customer service,
- providers of software for telephone customer and potential customer service in connection with services,
- payment platform providers: PAYU S.A., Stripe payments, Krajowy Integrator Płatności S.A. (Tpay.com) through which you can pay for our services,
- providers of invoicing software,
- entities providing accounting and bookkeeping services,
- providers of additional services provided by the Administrator, i.e., registrars of SSL data encryption services and law firms,
- companies providing courier or postal services.
Do we transfer your data to countries outside the European Economic Area?
As part of the Administrator's use of tools supporting its current activities, provided, for example, by Google, the Client's Personal Data may be transferred to a country outside the European Economic Area, in particular to the United States of America (USA) or another country where a cooperating entity maintains tools used for processing Personal Data in cooperation with the Administrator. Appropriate safeguards for the transferred Personal Data have been ensured by the Administrator through the use of standard data protection clauses adopted pursuant to the decision of the European Commission and data processing entrustment agreements that meet the requirements of the GDPR. In the case of transferring data from Europe to the USA, some entities located there may additionally ensure an adequate level of data protection under the so-called Privacy Shield program. In some places, we use the Google Recaptcha mechanism to block automatic inquiries (robots).
Cookies Policy
The Service does not automatically collect any information, except for information contained in cookies.
Cookies (so-called "cookies") are IT data, in particular text files, which are stored on the Service User's end device and are intended for the use of the Service's websites. Cookies usually contain the name of the website they come from, the time of their storage on the end device, and a unique number.
The entity placing cookies on the Service User's end device and gaining access to them is the Service operator, Avco Coatings sp z o.o. with its registered office in Warsaw, ul. Halki 23.
Cookies are used to:
- a) adapt the content of the Service's websites to the User's preferences and optimize the use of the websites; in particular, these files allow recognition of the Service User's device and the appropriate display of the website, tailored to their individual needs;
- b) create statistics that help understand how Service Users use the websites, which enables the improvement of their structure and content;
- c) maintain the Service User's session (after logging in), thanks to which the User does not have to re-enter their login and password on every subpage of the Service;
- d) integrate websites with social media services (Facebook, Twitter, Google+, Instagram).
Two basic types of cookies are used within the Service: "session" cookies and "persistent" cookies. "Session" cookies are temporary files that are stored on the User's end device until logging out, leaving the website, or turning off the software (web browser). "Persistent" cookies are stored on the User's end device for the time specified in the cookie parameters or until they are deleted by the User.
The following types of cookies are used within the Service:
- a) "necessary" cookies, enabling the use of services available within the Service, e.g., authentication cookies used for services requiring authentication within the Service;
- b) security cookies, used, for example, to detect abuse in authentication within the Service;
- c) "performance" cookies, enabling the collection of information about how the Service's websites are used;
- d) "functional" cookies, enabling "remembering" the settings selected by the User and personalization of the User interface, e.g., in terms of the chosen language or region from which the User comes, font size, website appearance, etc.;
- e) "advertising" cookies, enabling the delivery of advertising content more tailored to the User's interests.
- In many cases, the software used for browsing websites (web browser) defaults to allowing the storage of cookies on the User's end device. Service Users can change cookie settings at any time. These settings can be changed in particular to block the automatic handling of cookies in the web browser settings or to inform about their placement on the Service User's device each time. Detailed information about the possibilities and methods of handling cookies is available in the software (web browser) settings.
- The Service Operator informs that restrictions on the use of cookies may affect some functionalities available on the Service's websites.
- Cookies placed on the Service User's end device and used may also be used by advertisers and partners cooperating with the Service operator.
Do we process data in an automated manner?
Personal data is processed in an automated manner. We receive it from partners and transfer it to IT and logistics operators for the purpose of performing the agreement and/or informing about the progress of agreement performance.
